Workers’ Compensation
|

The firm's Wills, Estates, Trusts, Planning, Probate and Litigation
Department is managed by Jeffrey V. Matteo, Esquire who has been
associated with Fox and Fox for over 26 years and Shirlee Anne Miller,
Probate and Estate Paralegal who has been associated with Fox and Fox for
over 25 years. Our firm prepares wills, living wills, and powers of attorney.
We stress the importance of having a last will and testament as part of
an overall estate plan. In addition, we make available to our clients
a living will so that the individual can make their own determination
as to what if any measure will be taken in the event of a terminal condition
resulting in incapacity.
With the preparation of a last will and testament we explain the process
to the testator of estate distribution, after death, including tax consequences
and non-probate alternatives. The client who writes a last will and testament
designates an executor or executrix to administer his or her estate. The firm
provides all services to the executor and administrator for the administration
of the estate including assistance with the sale of real estate, and
representation throughout the sale process up through and including the real
estate closing, a gathering of assets including the closing of bank, mutual
funds and brokerage accounts of the decedent, application for a tax i.d. number
for the estate and the opening of accounts for the estate, preparation and
filing of the necessary tax returns, payment of outstanding debts of the decedent
and administrative expenses of the estate, preparation of releases for beneficiaries
and distribution of specific and residual bequests to estate beneficiaries.
We stress the importance of a durable power of attorney to be given by an individual
to a trusted relative, friend or corporate fiduciary who can transact business on
behalf of the individual even after the individual becomes mentally incapacitated.
For those individuals who have become incapacitated who have not designated an agent
to act on their behalf in the event of their incapacity, a petition for appointment
of guardian must be filed with the Orphans' Court which will make a determination
after a full hearing that the individual is an incapacitated person requiring the
services of a court appointed guardian.

Social Security |
Individuals applying for Social Security Disability, Social Security
Supplemental Income, Disabled Children Benefits and/or Disabled Widow
Benefits would be well advised to retain competent counsel. Statistics
clearly show that a significantly higher percentage of cases being
proved when an individual is represented by competent counsel. The
Law Firm of Fox and Fox, for the past 25 years, has successfully
represented thousands of individuals applying for Social Security
benefits. In order for an individual to be found disabled, all relevant
medical and psychological evidence must be gathered, sorted, and
presented to the Social Security Administration in a timely manor.
Fox and Fox has ample resources in which to obtain the evidence required
in a timely manor and present same to the Administration which often
proves dispositive. Although Social Security Law is quite complex,
involving numerous Federal regulations, and rulings, individuals must establish that:
- he/she has not preformed substantial gainful employment within t
welve months of the date of alleged onset or has a disability expected to end in death
- that the individual has an severe impairment which causes more than
a minimal effect on his/her ability to work/or to do/perform work related activities
- that the individual has an impairment that meets/equals the Social
Security Listings under Appendix I of Subpart P of Regulation No. 4
- that the individual is unable to return to any of is/her past
relevant work within fifteen years, and
- that the individual does not have the residual functional capacity
to partake in any substantial gainful employment which is defined by
the rulings as the ability to maintain regular and sustained employment.
Often credibility is an issue and therefore the Administration looks
to medically determinable impairments established by objective studies
as well as consistency in the individual’s diagnosis, treatment,
medications, prognosis, and various statements. The Claimant’s statements
to the Administration as well to his/her medical providers along with
statements of lay individuals and treating examining physicians is often crucial to the case.
