Divorce in Pennsylvania


Fox and Fox has a team of five attorneys who primarily focus their practice on matters relating to family law including divorce proceedings. Pennsylvania is a No Fault divorce state, which means that divorces are pursued primarily on the basis of an irretrievable breakdown between the parties. However, a family law attorney at Fox and Fox can discuss and explain to you the various grounds for divorce available under the law and whether including a fault ground in your divorce may or may not benefit you.

The family law attorneys at Fox and Fox can also guide you through all aspects of a divorce proceeding from commencing an action by filing and/or defending against a Complaint in Divorce, to requesting marriage counseling, filing for support, filing for equitable distribution and seeking various claims for special relief including exclusive possession of the marital residence or injunctive relief.

The family law attorneys at Fox and Fox are well versed in the Family Law Judges’ expectations and the eleven factors set forth in the Pennsylvania Divorce statute, which the court places heavy emphasis on when making a determination for equitable distribution.

The Fox and Fox family law attorneys can also review with you various options for resolving your divorce including but not limited to entering into a Property Settlement Agreement, participation in mediation, or litigation by attending an equitable distribution conference before an Equitable Distribution Master.

 

Custody Matters


Fox and Fox has a team of five attorneys who primarily focus their practice on matters relating to family law including custody matters. The family law attorneys at Fox and Fox can review with you the various types of custody, including both legal and physical custody, and discuss with you the Court’s position relating to partial physical custody, primary custody and shared physical custody. Fox and Fox family law attorneys are also familiar with a variety of custody schedules and can discuss with you your family dynamic and what type of custody schedule may most benefit your family.

The family law attorneys at Fox and Fox can guide you through all aspects of a custody matter from commencing an action by filing a Complaint for Custody to attending mediation and explaining to you what occurs at a custody conciliation conference, a short list conference and a subsequent hearing or custody trial. The family law attorneys at Fox and Fox are well versed in the Family Law Judges’ expectations and the sixteen custody factors set forth in the Pennsylvania Custody statute, which the court places heavy emphasis on when making a custody determination.

Spousal Support/Alimony Pendente Lite/Child Support


Fox and Fox has a team of five attorneys who primarily focus their practice on matters relating to family law including support matters. In Pennsylvania, parties who are married, but separated, living in different households, and who have not yet commenced an action for divorce may be entitled to spousal support depending on the parties’ respective income levels. If the parties also have children together, there may also be a need to seek child support.

The family law attorneys at Fox and Fox can guide you through all aspects of a support matter from commencing an action by filing a Complaint for Support, attending a support conference in Domestic Relations, attending a hearing before one of the support Masters or filing Exceptions and appearing before a Family Law Judge relating to a support obligation. The family law attorneys at Fox and Fox are well versed in the Family Law Judges’ expectations and the support guidelines set forth in the Pennsylvania Support Statute.

Fox and Fox’s family law attorneys are also available to discuss with you options for seeking a potential deviation to a support obligation, including but not limited to whether or not you or your spouse may be entitled to seek a mortgage contribution in connection with financial obligations encumbering a marital residence.

The family law attorneys at Fox and Fox can also review with you the various types of support that may be involved in your matter, including spousal support and alimony pendent lite (“APL”) and discuss with you any obstacles that may limit or interfere with you or your spouse’s entitlement to support.

Pre-Nuptial Agreements/Post-Nuptial Agreements


Fox and Fox has a team of five attorneys who primarily focus their practice on matters relating to family law including the preparation of Pre-Nuptial Agreements and Post-Nuptial Agreements.

Whether you are recently engaged and you and your fiancé want to memorializing the handling of various assets that each of you currently have titled in your individual names prior to getting married, a family law attorney at Fox and Fox can sit down with you and discuss the pros and cons of entering into a Pre-Nuptial Agreement.

The Fox and Fox family law attorneys can also discuss with you what it means to have separate property apart from your spouse and how such property is treated during a marriage and in a subsequent potential divorce proceeding.
The family law attorneys at Fox and Fox can also discuss with you other options that you may seek to include in your Pre-Nuptial Agreement including but not limited to which spouse will retain the marital residence in the event of separation of divorce.

The family lawyers at Fox and Fox can also discuss options available to you if you and your spouse are contemplating a separation, but are not yet sure if the marriage is over. In some instances, there may be benefits to entering into a Post-Nuptial Agreement that outlines a division of assets between the parties, but that leaves the parties the opportunity to pursue reconciliation.
